Protective orders are injunctions or restraining orders precluding contact between perpetrator and victim in situations of domestic abuse, assaults, threats of bodily harm, emotional abuse of the elderly or of an at-risk adult, and stalking. A person seeking a restraining order must be able to show the Court that the threat is real and “imminent”. In otherwords, convincing the Court that without a restraining Order, this individual is likely to act on their threats OR continue their behaviors.
Generally, a protection order cannot be used just for purposes of forcing another individual out of a home when a couple is ending their relationship.
